Joeys Only | Go Fish! Contest Rules

ELIGIBILITY: This contest is open to Canadian residents (except residents of Quebec, P.E.I., Nova Scotia and New Brunswick) who at the time of entry have reached the age of majority in the province or territory in which they reside, except employees (and those with whom employees are domiciled) of the Contest Sponsor, and its advertising and promotional agencies, service providers and franchisees.

NO PURCHASE NECESSARY: To obtain a Game Card with an Instant Win scratch pad ("Game Card"), without purchase while supplies last and/or a copy of these Official Contest Rules ("Rules"), send a self-addressed, postage-paid envelope to: Joey's Only Franchising Ltd. - 20th Anniversary Go Fish Contest 514 - 42nd Avenue SE, Calgary AB T2G 1Y6, Canada. Only one (1) Game Card will be returned per envelope with sufficient postage. All requests for a free Game Card must be received by October 28, 2005.

With any visit made during the Promotion Period to a participating Joey's Only Seafood Restaurants, you will receive one Game Card, while supplies last. Limit one Game Card per table. Food and Beverage prizes are valid on the next visit and cannot be used in conjunction with any other offers or discounts.

HOW TO PLAY: To be eligible for a prize, scratch off ONLY THREE (3) SQUARES of nine (9) in the Game Card play area, matching three (3) winning symbols. If all three (3) do not match, you are not an eligible winner but please try again. Please Note: Scratching more than three squares will void the Game Card.

PRIZES, DISTRIBUTION, ODDS OF WINNING: Over $1.31 Million in prizes are available to be won and the overall odds of receiving a potentially winning game card are approximately one(1) in three(3). At the onset, the approximate odds of being eligible to win each of the prizes are as follows:

NOTE: The odds of obtaining an eligible "winning" game card will change throughout the contest as game cards are distributed. The total number of prizes available to be won will decrease throughout the contest as Game Cards are distributed and prizes are claimed.

Grand Prizes

Ten (10) Mercedes Vouchers (Approximate Retail Value $17,945.00 excluding taxes, tire levy and GST) that can be used toward the purchase of a Mercedes smart for two Coupe cdi - Base Model with auto transmission, pure design with soft touch automatic, electric windows, central locking with radio remote control, steel wheels, smart radio cd player, fold-down passenger seat backrest, interior (scodic grey upholstery, contrast components, pure dials), solid roof, storage box in doors, pure logo in mirror triangle, black radiator grille and black tridion safety cell, are available to be won. Winners must have a valid driver's license and must pay vehicle insurance. One lucky game card will be distributed as a guaranteed win card for the Grand Prize. Odds of receiving this game card are 1 in 1,000,000. An additional nine (9) scratch and win game cards will be distributed with odds of 1/84 of scratching the correct game play areas to be eligible to win a Mercedes Voucher/Winners Certificate as described above. Odds of receiving one of these nine cards are 1 in 111,111. The Abbreviation of the winning Mercedes smart for two Coupe cdi Prize is "CAR". Scratch three(3) "CAR" squares and your Game Card will be verified as a winner, when submitted to the Contest Sponsor! Delivery of the vehicle depends on stock availability and the vehicle will be delivered to the Mercedes dealership closest to the winner's residence. Must be claimed by Wednesday, Nov. 30, 2005.

Distribution of high-level prizes (Mercedes Smart Car Voucher/Certificate, WestJet Flight Vouchers/Gift Certificates, Travelodge Gift Cards and Digital Cameras) within each region is random and the remaining prizes are distributed equally among participating Joey's Only Seafood Restaurants.

All "winning" Game Cards for Mercedes smart car Vouchers, WestJet Flight Vouchers, Travelodge Gift Cards and Digital Cameras have been individually inspected, produced and confirmed to be completely legible. Liability for irregular, illegible or blank Game Cards is limited to replacement of the Game Cards while supplies last.

Game Cards are subject to verification and are automatically void if more than three (3) latex squares on the Game Card are scratched off, if the Game Card is not obtained through legitimate channels, or is illegible, altered, forged, defaced, mutilated, tampered with or irregular in any way or if the Game Card contains printing or other errors. Liability for any irregular contest material is limited to replacement of contest material while supplies last.

Not all prizes will necessarily be awarded. Unclaimed prizing will not be awarded.

If you are eligible to win a 2Pc Fish and Chips, Coca Cola Beverage, Shrimp Add On, Mud Pie Dessert, Calamari or Fat Fish Plush Toy, complete the contest prize claim form on the back of your winning Game Card and correctly answer the skill-testing question, present it to a participating Joey's Only Seafood Restaurant on your next visit. Before being declared a winner, your Game Card and answer to the arithmetical skill-testing question must be verified. PLEASE NOTE: Food prize products may not be substituted for another product (except for Joey's Food Court locations where the Mud Pie will be substituted for a food prize of equal or greater value). No cash alternative will be made available. A food prize claim may not be used in conjunction with any other deal, combo or offer. All Food, Beverage and Toy prize claims must be received by the end of the business day on or before December 31, 2005. Claims received after December 31, 2005 for Food, Beverage and Toy prizes are null and void. Unclaimed prizes will not be awarded.

If you are eligible to win a Mercedes smart car Voucher, WestJet Flight Voucher/Gift Certificate, Travelodge Gift Certificate or Digital Camera, call Contest Sponsor toll free number at 1-800-661-2123. Identify yourself as a winner of the Joey's Only "Go Fish" Scratch and Win game and the contest sponsor will send you a prize claim package. Attach your completed "winning" Game Card to a completed Prize Claim Declaration, Release and Discharge Form provided within the prize claim package and send by Registered Mail to: Joey's Only Franchising Ltd. 514 - 42nd Avenue SE, Calgary AB T2G 1Y6. Joey's Only is not responsible for lost or stolen Game Cards or prize claims. Upon receipt of your completed prize claim package, in order to be declared a winner you must have correctly answered, the mathematical, skill-testing question featured within your prize claim package.

PLEASE NOTE: Mercedes smart car Vouchers, WestJet Flight Vouchers/Gift Certificates, Travelodge Gift Cards and Digital Camera Claims must be received at the above appropriate address no later than December 16, 2005. These Game Cards must be accompanied by the fully completed Prize Claim Declaration, Release and Discharge Form. Failure to deliver the Game Card and form(s) by December 16, 2005 will render the prize claim null and void. Unclaimed prizes will not be awarded. WE STRONGLY RECOMMEND YOU SEND THE COMPLETED CONTEST PRIZE CLAIM FORM AND PRIZE GAME CARD BY REGISTERED MAIL (with return receipt requested) TO THE APPROPRIATE ADDRESS AND KEEP A COPY FOR YOUR RECORDS. Submission of Game Cards and prize claim packages is the sole responsibility of the individual claiming a prize. Joey's Only Seafood Restaurants Store Owners, Operators and Staff are not allowed to submit or accept Game Cards on behalf of potential winners. If any prize notification or any prize is returned as undeliverable, prize will be forfeited.

All prizes will be awarded at the end of the contest, subject to completion of validation of eligibility and documentation. The contest sponsor will fulfill the top 4 prize levels within 6-8 weeks. The prizes including the WestJet Flight Vouchers/Gift Certificates, Digital Cameras, and Travelodge Gift Cards will be delivered to the Joey's Only restaurant nearest the winner's residence where a formal presentation will be made. The Mercedes smart car voucher(s) will be delivered to the Mercedes dealership nearest the winner's residence where a formal presentation will be made.

GENERAL

In order to be awarded any prize, the claimant's answer to the mathematical skill-testing question must first be verified and deemed to be correct. Claimants of major prizes must complete and sign a Declaration and Release form confirming compliance with the Rules, acceptance of the prize as awarded, without substitution, and releasing the Contest Sponsor, its officers, directors, employees, agents, representatives, successors and assigns, its affiliated companies, service providers, franchisees, advertising and promotional agencies from any liability in connection with any prize or this Contest. The signed Declaration and Release form must be returned within the time period specified on the form or the prize will be forfeited.

Selected entrants may be required to sign an affidavit of Eligibility to ensure compliance with eligibility requirements.

The Contest Sponsor accepts no responsibility for loss, damage or claims caused by or resulting from the awarding of any prize or participation in the contest. By claiming or accepting a prize, each winner consents to the use of his/her name, address (city and province) and/or photograph without further remuneration, in connection with any publicity carried out by or on behalf of the Contest Sponsor.

If due to a printing or other error, more Scratch and Win prizes are claimed than intended at any level as set out above, no further "instant win" prizes will be awarded at that level and a random draw will be held on December 16, 2005 in Calgary, Alberta from among all eligible claimants for the prize in question, to award the remaining number of advertised prizes. In no event will the Contest Sponsor be liable for more than the advertised number of prizes.

The Contest is subject to all applicable Federal, Provincial and Municipal laws and regulations.

All entries/prize claims become the property of the Contest Sponsor, who will not be responsible for late, lost, stolen, damaged, misdirected, illegible, incomplete, falsified, or destroyed Game Cards or prize claim documents. The Contest Sponsor does not assume any responsibility for incorrect or inaccurate capture of entry information, human or technical error, printing errors or any combination thereof. Entries are subject to verification and will be declared invalid if they are illegible, mechanically reproduced, mutilated, forged, falsified, altered or tampered with in any way. Entrants agree to abide by the Rules and the decisions of the independent judging panel, which are final. The Contest Sponsor reserves the right to terminate or suspend this contest or to amend these contest rules at any time without notice. All prizes must be accepted as awarded and are not transferable or convertible to cash. No substitutions except at the Sponsor's option. All decisions of the Contest Sponsor and/or contest judges with respect to all matters relating to this contest are final and binding.
